Terms and Conditions
Yona Consulting e.U. · Last updated: October 2026
This is a courtesy translation. The German version is legally binding.
Clear rules build trust. These terms apply to working with Yona Consulting e.U., owner Georges Younes, MSc, Colerusgasse 11/1, 1220 Vienna, FN 690716 i, Commercial Court of Vienna.
§ 1 Scope
(1) These terms apply to all services of Yona Consulting e.U.: management consulting, leadership coaching, facilitation, keynotes, trainings and mediation, on site, online and hybrid.
(2) Mediations are additionally governed by the respective mediation agreement and the Austrian Civil Law Mediation Act (ZivMediatG), which take precedence over these terms.
(3) Anything agreed individually in an offer or contract takes precedence over these terms. Deviating terms of the client apply only if Yona Consulting e.U. agrees to them in writing.
(4) For consumers within the meaning of the Austrian Consumer Protection Act (KSchG), these terms apply only insofar as the KSchG and other mandatory provisions do not provide otherwise.
§ 2 First conversation, offer and contract
(1) The first conversation (around 30 minutes) is complimentary and non-binding.
(2) Offers are valid for 30 days unless stated otherwise.
(3) A contract is concluded by written acceptance of the offer (email is sufficient) or by signing a contract.
(4) Prices on the website and in offers are final prices; no VAT is currently charged (§ 6 (1) no. 27 UStG). If this changes, the fee is subject to statutory VAT; consumers will then receive offers showing gross prices.
§ 3 Services and way of working
(1) What is owed is careful, competent support, not a specific outcome. Decisions and their implementation remain with the client.
(2) Yona Consulting e.U. may involve suitable colleagues and will inform the client in advance. They are bound by the same duty of confidentiality.
(3) Clear roles: anyone advised by Georges Younes in a matter cannot be mediated by him in the same matter (§ 16 ZivMediatG). In that case he will recommend a colleague.
§ 4 Cooperation
The client provides all necessary information in good time, names a contact person and arranges suitable rooms and times, and for online sessions a quiet environment and a stable connection.
§ 5 Confidentiality
(1) As a registered mediator, Georges Younes is bound by law to confidentiality (§ 18 ZivMediatG). He applies this in every role, including consulting, coaching, facilitation and training.
(2) What individuals tell him in confidence is passed on only with their consent. Organisations receive results and recommendations, not statements by individuals.
(3) Online sessions and workshops are not recorded unless everyone involved expressly agrees.
§ 6 Fees, expenses and payment
(1) The fee stated in the offer applies, plus statutory VAT.
(2) Travel expenses are charged at cost: rail second class, the official mileage allowance when travelling by car, accommodation as per receipt. No travel expenses are charged within Vienna.
(3) Invoices are payable within 14 days without deduction. Longer assignments are invoiced in instalments.
(4) In the event of late payment, statutory default interest applies. Yona Consulting e.U. may suspend further services until payment is received.
§ 7 Rescheduling and cancellation
(1) If the client cancels or reschedules: workshops, trainings, retreats and consulting sessions free of charge up to 14 days before, then 50 %, and from 7 days before 100 % of the fee for the session. Individual coaching sessions free of charge up to 48 hours before, after that the full fee is charged. For mediations, the rules in the mediation agreement apply. Anything Yona Consulting e.U. saves through the cancellation, or earns by using the time otherwise, is credited.
(2) Travel and room costs already incurred are reimbursed in any case.
(3) If Georges Younes cannot attend a session due to illness or force majeure, a new date is arranged. No further claims arise from this.
§ 8 Materials and rights
(1) Presentations, concepts, methods, worksheets and other materials remain the intellectual property of Yona Consulting e.U. They may be used for the client's own internal purposes. Passing them on, publishing, copying or using them for other projects requires written consent.
(2) Yona Consulting e.U. names clients as references only with their consent.
§ 9 Warranty and liability
(1) Towards businesses, Yona Consulting e.U. is liable only for intent and gross negligence, except for personal injury, and limited to the fee for the assignment concerned. Claims by businesses lapse unless asserted in court within six months of becoming aware of the damage and the party responsible.
(2) Towards consumers, liability for slight negligence is excluded, except for personal injury. Consumers' statutory warranty rights remain unaffected.
(3) Yona Consulting e.U. holds professional liability insurance: for mediation with Generali Versicherung AG pursuant to § 19 ZivMediatG, for management consulting with R+V Allgemeine Versicherung AG, Austrian branch, under the group contract for members of the UBIT association of the Austrian Economic Chamber.
§ 10 Consumers' right of withdrawal
(1) Consumers who conclude a contract at a distance (for example by email, online or by phone) or off-premises may withdraw within 14 days of conclusion of the contract without giving reasons, under the Austrian Distance and Off-Premises Contracts Act (FAGG). A clear statement by email to hello@yona.consulting or by post to the address above is sufficient. It is enough to send it within the deadline.
(2) Services begin within the withdrawal period only at the consumer's express request. Anyone who then withdraws pays a proportionate amount for the services provided up to that point. Once the service has been fully provided at the consumer's express request, the right of withdrawal no longer applies.
(3) Payments already made are refunded within 14 days of receipt of the withdrawal, less any proportionate amount under paragraph 2.
§ 11 Data protection
Yona Consulting e.U. processes personal data only insofar as necessary for the service, legal obligations and billing. Details are set out in the Privacy Policy.
§ 12 Resolving disagreements
Conflict is my craft, including my own: in case of disagreement, both sides first seek a conversation and, if necessary, a solution with an independent registered mediator before going to court. Statutory deadlines remain unaffected.
§ 13 Final provisions
(1) Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of their country of residence.
(2) The place of jurisdiction for businesses is Vienna. For consumers, the statutory places of jurisdiction apply.
(3) Amendments and side agreements must be made in writing; email is sufficient. Towards consumers, oral commitments also remain binding.
(4) Should any provision be invalid, the remaining provisions remain valid.
